DMCA Copyright Policy

How JAC Collective Co. responds to copyright claims under the Digital Millennium Copyright Act.

1. Our Position

JAC Collective Co., LLC respects the intellectual property rights of others. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

This policy explains how to submit a DMCA notice, how we will respond, and what a counter-notice looks like.

2. Designated DMCA Agent

Note: a dedicated dmca@jaccollectiveco.com address should be set up as a forwarder before launch. Use alex@ as fallback until then.

3. Filing a DMCA Notice

A valid DMCA notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, a representative list.
  3. Identification of the allegedly infringing material, with enough detail to allow us to locate it (URL of the page or post, name of the file, in-app location, or similar).
  4. Your contact information: full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement made under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or are authorized to act on their behalf.

Send the complete notice to the Designated Agent above. Notices missing any required element may be returned to the sender.

4. Our Response to a Valid Notice

On receipt of a notice that substantially complies with the DMCA:

  1. We will review the notice for completeness and good-faith basis.
  2. We will promptly remove or disable access to the allegedly infringing material.
  3. We will notify the user who posted or uploaded the material (where applicable), provide a copy of the notice, and explain that the material has been removed.
  4. We will retain records of the notice and our response for the period required by law and our internal recordkeeping practices.

5. Counter-Notice

If you believe your material was removed in error, you may submit a counter-notice. A valid counter-notice must include:

  1. A physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your contact information: full legal name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court in the district where your address is located (or, if outside the U.S., the federal district court in Clark County, Nevada), and that you will accept service of process from the original complaining party.

Send the counter-notice to the Designated Agent listed in Section 2.

On receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within ten (10) to fourteen (14) business days that they have filed an action to restrain the alleged infringement, we may restore the material.

6. Repeat Infringer Policy

JAC Collective will terminate, in appropriate circumstances and at its discretion, the accounts of users who are determined to be repeat infringers of copyright. "Repeat infringer" is interpreted in light of the totality of circumstances, including the number, severity, and pattern of infringement notices received.

7. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not submit a DMCA notice or counter-notice unless you have a good-faith basis.

8. Trademark & Other IP Claims

This policy applies to copyright. For trademark, right of publicity, or other intellectual property claims, contact alex@jaccollectiveco.com. We will review and respond consistent with applicable law.

9. Content Produced by JAC for Clients

JAC Collective produces content from source material provided by client churches. Under the Client Service Agreement, the client represents that it holds all rights necessary to authorize JAC's use of the source material. If a client provides material that infringes a third party's rights, the client is responsible for indemnifying JAC Collective. JAC Collective will still respond to DMCA notices as set out in this policy regardless of the original source.

10. Music Licensing

Music used in JAC Collective-produced content is licensed through our music licensing provider (Epidemic Sound, Artlist, or equivalent). License confirmations are retained on file. If you believe music used in a JAC-produced clip infringes your rights, please follow the DMCA process above and include the specific track in question.

11. Updates

We may update this policy. Material changes will be reflected in the "Last Updated" date at the top of this page. Continued use of our Services after the effective date of any change constitutes acceptance of the updated policy.
